Cami is a WhatsApp-first platform that lets businesses (“Merchants”) serve their customers (“Customers”), including taking bookings, orders, and payments.

The services and products you book or buy are provided by the Merchant, not by Cami. Your contract for them is directly with the Merchant. Cami acts as the Merchant’s commercial agent to arrange and conclude your booking or order.

When you pay through Cami, we collect your payment on behalf of the Merchant as their agent. Once we receive it, your obligation to pay the Merchant for that booking or order is settled.

Cancellation, refund, deposit, and no-show rules are set by each Merchant and shown to you before you confirm. Please read them. Questions? support@getcami.io

1. About These Terms

These Terms of Service (“Terms”) are a legally binding agreement between you and Cami Technologies Limited, a company registered in the Dubai International Financial Centre (DIFC), with its registered office at OT 09-35, Level 9, Central Park Offices, Dubai International Financial Centre, Dubai, United Arab Emirates (“Cami,” “we,” “us,” or “our”).

These Terms govern your access to and use of the Cami platform, including our WhatsApp-based services, web interfaces, and any related tools and services (together, the “Platform” or “Services”). By accessing or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

How we handle your personal data is described in our Privacy Policy, which forms part of these Terms.

1.1 Who these Terms apply to
  • Merchants – businesses that use Cami to manage their operations, customers, bookings, orders, and payments.
  • Customers – people who interact with a Merchant through Cami to book services, buy products, communicate, or make payments.

Some sections apply only to Merchants or only to Customers. Where that is the case, we say so.

2. Our Role

Cami provides the Platform that connects Merchants and Customers. The services and products offered through the Platform are provided and sold by Merchants, not by Cami. Cami does not own, create, control, or deliver any Merchant service or product.

Cami acts as the commercial agent of each Merchant for the limited purpose of arranging and concluding bookings and orders, and collecting payment, on that Merchant’s behalf. When a Customer makes a booking or order, the contract for the underlying services or products is formed directly between the Customer and the Merchant. Cami is not a party to that contract.

Cami does not guarantee the existence, quality, safety, suitability, or legality of any Merchant service or product, the accuracy of any Merchant listing or description, or the conduct of any Merchant or Customer. Each user should exercise their own judgment before transacting.

Due to the nature of internet and messaging services, we cannot guarantee that the Platform will always be available or uninterrupted. We may restrict, suspend, improve, or modify the Platform or any feature from time to time.

3. Eligibility and Accounts

To use the Platform, you must be at least 18 years old (or the age of majority where you live) and able to enter into a binding contract. If you register on behalf of a business, you confirm you are authorized to bind that business to these Terms.

You must provide accurate, current, and complete information and keep it up to date. We may verify the information you provide and may refuse, suspend, or limit access to the Platform where appropriate.

You are responsible for keeping your account credentials secure and for all activity under your account. Tell us immediately at support@getcami.io if you suspect any unauthorized use. Unless we permit otherwise, you may not register more than one account or transfer your account to anyone else.

4. Using Cami over WhatsApp

Cami is WhatsApp-first. Much of your interaction with a Merchant, and with Cami, happens through WhatsApp. By using the Platform over WhatsApp, you agree that messages necessary to provide the Services (such as booking confirmations, reminders, and support) may be sent to you. Where required, business-initiated and marketing messages will be sent only after you have opted in, and you can opt out at any time. Your use of WhatsApp is also subject to WhatsApp’s and Meta’s own terms.

5. Terms for Merchants

If you use Cami as a Merchant, the following applies to you.

  • Your listings and policies. You are responsible for the accuracy of your services, products, prices, availability, and any rules you set (including cancellation, no-show, deposit, and refund policies). Your policies must be disclosed through the Platform and must not conflict with these Terms.
  • Service delivery. You are solely responsible for providing the services and products you offer, and for honoring any booking or order a Customer makes through the Platform.
  • Compliance. You are solely responsible for identifying and complying with all laws, licenses, permits, registrations, and tax obligations that apply to your business. Cami does not provide legal or tax advice; seek your own where needed.
  • Independence. You act on your own behalf as an independent business. Nothing in these Terms creates an employment, partnership, or joint venture relationship between you and Cami, except that you appoint Cami as your commercial agent for the limited purposes described in Section 2 and Section 7.
  • Payout details. You must provide and keep current accurate bank or payout details so that Cami can remit amounts owed to you.
  • Your customer data. Where you upload or provide data about your own customers, you remain responsible for it, as described in our Privacy Policy, including for having any consent required.

6. Terms for Customers

If you use Cami as a Customer, the following applies to you.

  • Making a booking or order. You can book services or buy products from a Merchant through the Platform. Before you confirm, the Merchant’s details, price, and any applicable policies (such as cancellation, no-show, deposit, or refund terms) will be shown to you. Please read and check them. Your contract for the service or product is with the Merchant.
  • Accurate information. You agree to provide accurate information and to pay the amounts due for any booking or order you make.
  • Health and other relevant information. It is your responsibility to tell the Merchant, in advance, of any medical, health, accessibility, or other relevant circumstances that may affect or be affected by the service or product. If you do not, neither the Merchant nor Cami is responsible for any resulting loss that could reasonably have been avoided.
  • Your legal rights. Nothing in these Terms removes any consumer rights you have under applicable law.

7. Payments

Where a Merchant enables online payment, Cami collects your payment as the Merchant’s commercial agent. When Cami receives your payment for a booking or order, your obligation to pay the Merchant for that booking or order is settled (discharged).

Payments are processed by our third-party payment providers, currently Stripe, NeoPay, and Network International, or other providers we may use from time to time. Your payment is also subject to the provider’s own terms. Cami does not see or store your full card or bank details; only our payment providers do. Cami is not responsible for errors by a payment provider.

Some Merchants may offer a “pay in person” option, where you book or order through the Platform but pay the Merchant directly at their premises. In that case, payment is between you and the Merchant, and the discharge described above does not apply until the Merchant receives payment.

Prices are shown in the currency stated at checkout. Any currency conversion or related charges are your responsibility. Where a payment provider does not support the smallest unit of a currency, Cami may round amounts to the nearest supported unit.

7.1 Taxes

Each Merchant is solely responsible for determining, charging, collecting, and remitting any taxes (such as VAT) that apply to their services or products. Cami is not the seller of Merchant services or products and does not assume the Merchant’s tax obligations.

8. Cami Fees (Merchants Only)

Use of the Platform is free for Customers. Cami charges fees to Merchants, for example a subscription fee and/or a per-transaction fee, as agreed with each Merchant. Applicable fees are disclosed to the Merchant before they take effect. Where Cami collects payments on a Merchant’s behalf, Cami may deduct its fees before remitting the balance to the Merchant. Except as required by law or stated otherwise, fees are non-refundable.

9. Cancellations, No-Shows, and Refunds

Cancellation, no-show, deposit, and refund rules are set by each Merchant and disclosed to the Customer before a booking or order is confirmed. By confirming, the Customer accepts the applicable Merchant policy.

Where a Merchant policy allows, Cami (as the Merchant’s agent) may charge the Customer the applicable amount, up to the full value of the booking or order, for a cancellation or no-show. Refunds, where due, are processed through the same payment provider used for the original payment. Cami is not responsible for the Merchant’s services or products and is not obliged to provide a refund beyond what the Merchant’s policy or applicable law requires.

10. Content and Intellectual Property

You may be able to create, upload, or share content through the Platform (“User Content”). You are responsible for your User Content and confirm you have the rights to share it and that it does not infringe anyone’s rights or break the law.

You grant Cami a non-exclusive, worldwide, royalty-free, sub-licensable license to host, use, store, and display your User Content as needed to provide and promote the Platform. We do not claim ownership of your User Content.

The Platform and all Cami content, trademarks, and branding are owned by Cami or its licensors. You may not copy, modify, reverse engineer, scrape, or exploit the Platform or Cami content except as these Terms allow.

11. Prohibited Activities

You agree not to, and not to help others to:

  • break any applicable law, regulation, third-party right, or these Terms;
  • use the Platform to arrange or take a booking, order, or payment off-platform in order to avoid Cami fees;
  • misuse, copy, or access another user’s personal information other than as permitted;
  • send spam or unsolicited commercial messages;
  • use bots, scrapers, or other automated means to access or collect data from the Platform;
  • circumvent, disable, or interfere with any security or technical measure;
  • reverse engineer or attempt to extract the source of the Platform; or
  • take any action that harms, overloads, or impairs the Platform, or harasses, discriminates against, or harms another person.

12. Disclaimers

The Platform and all content are provided “as is” and “as available,” without warranties of any kind, to the maximum extent permitted by law. Cami is not a party to, and is not responsible for, the contract between a Customer and a Merchant or for any Merchant service or product. Any verification or checks Cami may carry out do not guarantee a user’s identity, conduct, or suitability.

13. Liability

To the maximum extent permitted by law, Cami is not liable for any indirect, incidental, special, or consequential loss, or for loss of profits, revenue, data, or goodwill, arising out of or in connection with these Terms or your use of the Platform.

To the maximum extent permitted by law, Cami’s total liability arising out of or in connection with these Terms and your use of the Platform will not exceed the greater of (a) the total fees you paid to Cami in the twelve (12) months before the event giving rise to the liability, or (b) such minimum amount as cannot be excluded under applicable law. Nothing in these Terms excludes liability that cannot be excluded by law.

14. Indemnity

To the maximum extent permitted by law, you agree to indemnify and hold harmless Cami and its affiliates and their officers, directors, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of or connected with your use or misuse of the Platform, your breach of these Terms, your provision of or interaction in any Merchant service or product, or your breach of any law or third-party right.

15. Term, Termination, and Suspension

These Terms apply while you use the Platform. You may stop using the Platform and close your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms or applicable law, if we reasonably believe it is necessary to protect Cami, our users, or third parties, or to prevent fraud or other harm. Sections that by their nature should survive termination (including Content and IP, Disclaimers, Liability, Indemnity, and Dispute Resolution) will continue to apply.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms on the Platform, update the “Last Updated” date, and where appropriate notify you in advance. Your continued use of the Platform after the changes take effect means you accept the updated Terms.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Dubai International Financial Centre (DIFC).

Before starting formal proceedings, you and Cami agree to first try to resolve any dispute informally by contacting each other (you can reach us at support@getcami.io).

Any dispute, claim, or controversy arising out of or relating to these Terms, or the use of the Platform, that is not resolved informally will be referred to and finally resolved by arbitration under the Arbitration Rules of the DIFC-LCIA Arbitration Centre, which are deemed incorporated by reference. The seat of arbitration will be the DIFC, Dubai; the number of arbitrators will be one; and the language of the arbitration will be English. To the extent permitted by law, disputes will be resolved on an individual basis and not as part of a class or representative proceeding.

18. General

These Terms, together with the Privacy Policy and any policies referenced in them, are the entire agreement between you and Cami regarding the Platform. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver of it. You may not assign these Terms without our consent; we may assign them as part of a reorganization, merger, or sale. We may give notices to you electronically, including through the Platform, WhatsApp, or email.
